This Terms and Conditions of Service ("Agreement") is entered into between DatingApp Co., Ltd.("the Company," "Service Provider," or "We") the service users and/or website visitors ("Service User" or "You"). access to and use of our services, which include but are not limited to the mobile application, website, and other related services (hereinafter collectively referred to as the "Services"), constitutes your agreement to be bound by this Agreement unconditionally.The Company reserves the exclusive right to amend or modify these Terms and Conditions at any time without prior notice. By continuing to use the Services, you are deemed to have accepted and agreed to be bound by such amended or modified terms. Account Termination Terms

This action may be taken in the event that you violate any Terms or Conditions specified in this Agreement, or if the Company believes that your actions or use of the services could potentially harm the security, integrity, or reputation of the Company or other users.In the event that your account is suspended or permanently terminated, you will no longer have access to or be able to use any of the Company's services, whether under the original account name or a new account created thereafter. Once an account is suspended or terminated under these conditions, you will not be permitted to reactivate or use the services again under any account name.Upon the suspension of your account, all personal information and data related to your user account will be permanently deleted from the Company's systems. This data cannot be recovered and will not be reused after the account suspension. Furthermore, the Company disclaims any liability for damages that may arise from the loss of data or the suspension of the user account, including but not limited to damages resulting from the loss of personal data or other information that you have stored or transmitted to the Company.If you wish to voluntarily close your user account, you may do so through the account settings or by requesting account closure from the Company's support team. The closure will be processed in accordance with the procedures and relevant legal requirements established by the Company.6. Limitation of Liability
Service users agree and acknowledge that all communications or interactions with other user accounts on the Company's platform are the sole responsibility of the service users. The Company shall not be liable for any damages arising from your use of the services or from your communications with other service users, including but not limited to damages that may result from the actions of other users on the platform.The Company hereby informs that we do not conduct criminal background checks on service users, nor can we guarantee that all users will adhere to appropriate standards of conduct. Consequently, the Company cannot assure that users will not encounter incidents of sexual harassment or other inappropriate behavior during their communications or use of our services.In the event that you witness or experience any such incidents, the Company strongly advises that you report them immediately through the channels provided by the Company, so that appropriate measures can be taken to prevent and address the situation. However, the Company shall not be liable for any damages resulting from incidents that may affect the rights, health, physical well-being, property, reputation, or other forms of damage arising from the use of the Company's services, whether caused by the actions of other service users or events beyond the Company's control.7. Prohibited Activities in the Use of Services
When using our services, you are required to strictly adhere to all regulations and terms to ensure safe and appropriate use. The following provisions define the behaviors that must be observed and the prohibitions applicable to the use of our services.7.1 Conduct and Ethics in Service Use
In using our services, you agree to conduct yourself with civility and respect for the rights of all others. You shall not engage in any behavior that could be harmful or cause damage to other service users, such as harassment or intimidation, either directly or indirectly, including stalking or making others feel unsafe due to your actions. Furthermore, you must avoid seeking gain or engaging in any activities related to fraud, deceit, or impersonating another person for purposes that are legally prohibited.You may not collect personal data from others without their consent, nor may you imply or represent that you have been endorsed by the Company without authorization. Any actions that contravene these provisions will be considered a breach of the agreement and may result in the suspension or termination of your user account.7.2 Conduct and Ethics in Service Use

You are prohibited from disseminating or engaging in any activities related to content that is defamatory, misleading, or publishes material that is obscene, pornographic, or incites hatred towards others. Additionally, you may not distribute content that infringes on others' rights, such as copyright, trademark, or privacy rights, nor may you publish false information or misrepresent facts that could result in harm.Promoting illegal behavior, such as providing advice on illegal activities, engaging in data hacking, or infringing on the rights of others, constitutes a violation of these terms. Additionally, you are prohibited from sending unauthorized commercial communications, commonly known as "spam," through our platform.7.3 Security and Privacy Maintenance
To maintain the security of the platform and the personal data of users, you must not engage in any actions that could damage or pose risks to the system's security. You are prohibited from using software or automated tools to collect, index, or extract data from the platform without authorization from the Company. Furthermore, any interference with or damage to the network system or the operation of the platform also constitutes a violation of these terms.You are prohibited from uploading viruses, malware, or any harmful code that could damage our system or compromise the data of users or pose any risk to the security of any data. Additionally, falsifying data, or altering or deleting the source of content is unauthorized behavior. Lastly, you are not permitted to analyze vulnerabilities or conduct security testing on the platform without express authorization from us.7.4 Commercial Use and Rights of Use
You are granted the right to use the platform in a manner that is non-transferable and not assignable to others. You must not use the services in any way that contradicts this stipulation, particularly for commercial purposes without our express permission. If you wish to use the services for commercial purposes, you must obtain written consent from us.Furthermore, you are not permitted to copy, modify, edit, or create derivative works from our services without written consent from the Company. Additionally, the use of meta tags, codes, or other mechanisms that link to our platform or trade name with the intent to direct to another website without authorization also constitutes a violation of these terms.7.5 Legal Measures and Penalties
The Company reserves the right to monitor user behavior on the platform and to take appropriate actions in cases where violations of these terms are identified. If actions contrary to these terms are discovered, we reserve the right to take measures deemed appropriate, including but not limited to the removal of content that violates rules or terms, and the suspension or termination of user accounts without prior notice.8. User Representations and Warranties
Service users represent and warrant that they own the content posted or have the legitimate right to publish it and grant us the right to use such content without any legal restrictions or third parties conditions. Users must ensure that the content they provide does not infringe on others' rights, including but not limited to copyright, trademark rights, or privacy rights, which could potentially lead to legal issues.The content you submit must comply with the Terms and Conditions of the platform and must not violate any applicable laws or regulations. You are fully responsible for any consequences that may arise from your content and warrant that its dissemination will not create obligations that require us to seek permissions or pay royalties to third parties. We reserve the right to review, modify, or delete any content that does not meet our conditions, and you agree to indemnify and hold us harmless from any damages that may result from violations of these stipulations.9. Remedies for Damages
Should allegations arise that you have breached the terms of this agreement or have used our services in a manner that violates the law or infringes upon the rights of third parties, such as intellectual property rights or privacy rights, you are responsible for all resultant damages and must undertake to defend the company from any lawsuits or legal disputes that may occur.We reserve the right to independently control the defense and management of any case related to such claims. You are required to fully cooperate in defending against all such claims and proceedings. Additionally, you are responsible for covering all expenses and legal fees associated with the defense and indemnification for any damages incurred.10. Personal Data Policy and Usage
"Personal data" refers to any information that can directly identify an individual or when combined with other information. This may include, but is not limited to, name, address, date of birth, national identification number, email address, telephone number, gender, and other identifying information.The personal data you provide to us will be stored and used in accordance with the company's privacy policy, accessible through our website. However, as our platform is an online social network, you may choose to disclose your own information to other users, which could lead to risks of unauthorized use or disclosure to third parties without permission. We do not have control over the actions of other users. Thus, if you choose to disclose your personal data, you are responsible for the risks that may arise, and you acknowledge that we are not liable for any consequences resulting from unauthorized use of your data. This Agreement shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law principles.
